Terms of Service

1. Acceptance of Terms

By accessing or using the Whsky mobile application (the "Service"), operated by Real Estate Outlaws LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Whsky is a CRM and communication platform for licensed real estate professionals. It provides SMS messaging, voice calling, AI-powered contact management, lead scoring, and follow-up tools to help agents manage client relationships.

3. Eligibility

The Service is intended for use by licensed real estate professionals in the United States. By using the Service, you represent that you are a licensed real estate agent or broker, or are authorized to act on behalf of one.

4. Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and current information during registration.
• You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree:

• To only send messages to clients who have provided explicit consent to receive SMS communications from you, as described in our SMS/MMS Messaging Terms.
• To comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state-specific regulations regarding telecommunications and real estate.
• Not to use the Service for unsolicited bulk messaging, spam, or cold outreach to individuals who have not provided their contact information to you.
• To honor opt-out requests promptly and to not contact individuals who have opted out.
• To comply with all applicable call recording consent laws, including two-party consent requirements where applicable.

6. Messaging and Calling

The Service uses Twilio for SMS and voice communications. You acknowledge that:

• Message and call delivery is subject to carrier availability and is not guaranteed.
• You are solely responsible for the content of messages you send through the Service.
• Call recordings are made only with appropriate consent disclosures as configured in the platform.
• Standard messaging rates may apply to your recipients.
• Message frequency varies based on agent-client communication activity.
• Consent to receive messages is not a condition of any purchase.

6.1 Opt-Out Handling

When a recipient replies STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message sent through the Service, you must cease all further messaging to that recipient. The Service will automatically process standard opt-out keywords and send a confirmation message: "You have been unsubscribed and will not receive any more messages. Reply HELP for help or START to re-subscribe." No further messages will be sent after the opt-out confirmation.

6.2 Help Responses

When a recipient replies HELP to any message, the Service will automatically respond with support information including contact details (support@realestateoutlaws.com) and instructions for opting out. You must not interfere with or override automatic HELP responses.

7. AI Features

The Service uses artificial intelligence to extract data from conversations, generate summaries, score leads, and suggest follow-up messages. You acknowledge that:

• AI-generated content is provided as suggestions and should be reviewed before use.
• AI extraction may not be 100% accurate; you are responsible for verifying CRM data.
• Conversation data is processed by third-party AI providers (Anthropic) for these features.

8. Data Ownership

You retain ownership of all client data, messages, and content you create or upload to the Service. We do not claim ownership of your data. You grant us a limited license to process your data solely for the purpose of providing the Service.

9. Fees and Payment

The Service is offered on a subscription basis. Pricing, billing terms, and payment methods will be communicated during signup. We reserve the right to change pricing with 30 days notice.

10. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease. You may request export of your data within 30 days of termination.

11. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, error-free operation, or that the Service will meet all of your requirements.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
